    What is regulated in an Inheritance Contract?

    In contrast to a unilateral will, the contract of inheritance is an agreement between the testator and one or more contracting parties with the participation of two independent witnesses. By means of a contract of inheritance, the testator makes binding agreements with a person regarding his estate. By means of a will, however, the testator makes unilateral orders on his estate, which can be revoked at any time. The inheritance contract gives the possibility to regulate the inheritance with the cooperation of all parties concerned, according to the individual needs of the contracting parties, i.e. independently of the statutory claims to a compulsory portion.

    What is regulated in a Marriage Contract?

    With a marriage contract, the spouses can choose or change an estate status. However, you can only choose within the three property regimes prescribed by law (or certain mixed solutions), other solutions are not possible. In the absence of a contractual provision, the ordinary matrimonial property regime shall apply. Separation of property is the most common contractual arrangement. With the separation of property, the assets of both spouses remain completely separate. There is no mutual participation in the assets of the other spouse, which is why no settlement of matrimonial property rights is to be made upon dissolution of the marriage. However, it is important to keep the assets clearly and unambiguously separated.
    The agreement on the separation of assets has no effect on old-age provision (1st and 2nd pillars), nor on the obligation to provide long-term maintenance.

    Assets Contracts in accordance with the German Partnership Act

    In a registered partnership the separation of property constitutes the ordinary matrimonial property regime. By agreeing that the assets are to be divided in accordance with the provisions on the participation in conquests, further alignment with matrimonial law can be achieved.
