    The Pension Contract

    What happens if you suddenly lose your judgment? who decides for you when you have a serious accident? Who decides for your company?

    Any person capable of acting can use a pension contract to determine who, in the case of inability to judge, should be responsible for making decisiones about his/her care, the management of assets and other legal transactions. It must describe precisely the tasks of the authorized person, who may be a natural or legal person (e.g. a bank or organisation). It may also issue instructions on how these tasks are to be performed and, for example, prohibit certain investments. Representation can be comprehensive or limited (e.g. to financial matters).

    Anyone who sets up a pension contract makes a decision of major importance. Certain formal requirements are therefore laid down. A publicly notarized pension contract prevents elderly persons in particular from signing a paper written by third parties without giving sufficient account of its content.

    The establishment of the pension order and its place of deposit can be entered in the civil registry office (Infostar). In this way, the person concerned ensures that their pension mandate does not remain a dead letter. In the event of their inability to judge, the Adult Protection Authority will check with the Civil Registry Office to see whether a pension plan has been issued and, if necessary, whether it has been validly established. Once all requirements for its effectiveness have been met, the Adult Protection Authority shall issue the person in charge with a document setting out their duties and rights.
